The Site provides information about Voitta's software and services. The Site is provided for informational purposes only. Nothing on the Site constitutes a binding offer, a warranty of product performance, or professional advice.
Voitta Community and other Voitta open source software are made available under separate open source license terms — the license identified in the applicable source repository at github.com/voitta-ai (for example, the GNU Affero General Public License v3.0 or the MIT License, depending on the repository). Your use of Voitta open source software is governed exclusively by the applicable open source license, not by these Terms. To the extent these Terms conflict with an applicable open source license with respect to that software, the open source license governs. No fees charged by Voitta apply to open source components for which fees may not be charged under the applicable license.
Voitta Enterprise, including deployment, configuration, support, and related professional services, is provided only under a separately executed written agreement (such as a master services agreement and order form) between Voitta and the customer. These Terms do not grant any right to use Voitta Enterprise, and no description of Voitta Enterprise on the Site forms part of any contract for those services.
The Site and its contents — including text, graphics, logos, page designs, and illustrations — are owned by Voitta or its licensors and are protected by copyright, trademark, and other laws. Except for the open source licenses described in Section 2, no license or right is granted to you by implication or otherwise. "Voitta" and associated logos are trademarks of Voitta Inc. Open source licenses applicable to our software do not grant any right to use our trademarks.

The Site links to third-party sites and services, including GitHub. We do not control and are not responsible for third-party sites, their content, or their terms and privacy practices. Your use of them is at your own risk and subject to their terms.
If you send us ideas, suggestions, or other feedback about the Site or our products, you grant Voitta a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose without obligation to you. This section does not apply to code contributions to our open source repositories, which are governed by the applicable repository's license and contribution terms.
THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOITTA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOITTA'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
You agree to indemnify and hold harmless Voitta from and against any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Kings County, New York, and you consent to personal jurisdiction and venue there.
We may update these Terms from time to time. The "Last updated" date above reflects the effective date of the current version. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver. These Terms are the entire agreement between you and Voitta regarding the Site and supersede prior agreements regarding the Site. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
